Over MidNight Date variable Chance

If I import Through midnight (often) my images end up in 2 dated folders. Would it be possible to use the date for storing images & creating folders to be from the start of ingesting?

The variables evaluation doesn't know that an Ingest is going on at all.  Nothing is keeping you from just entering a date in your own format instead of using the dated folder option.

That's what I suggest you do.
